Terms of Service

These Terms of Service (“Terms”) govern your use of GotSmarty, including the website at https://gotsmarty.com, the assessments, reports, share images and challenge links (together, the “Service”). The Service is operated by Charlie Labs, Inc., a Delaware corporation (“Charlie Labs”, “we”, “us”). By using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Who can use GotSmarty

You must be at least 18 years old, or the age of majority where you live if that is higher, to use the Service or make a purchase. The Service is intended for people in the United States.

2. What GotSmarty is — and isn’t

GotSmarty is an entertainment-oriented reasoning assessment. It is not an IQ test, has not been clinically or scientifically validated, and is not a medical, psychological, educational, employment or diagnostic tool. Scores, labels and descriptions reflect your answers to this assessment only. Do not use them to make decisions about yourself or anyone else, and do not rely on them in place of advice from a qualified professional.

Performance labels (such as “Strong”) describe how you did on this assessment and do not compare you with other people. We will only show comparisons with other test takers when we have enough real results to calculate them, and we will say who the comparison group is.

3. Free and paid parts of the Service

The quick test, the complete assessment and the preliminary result are free. The detailed report is a paid, one-time digital purchase. The price is shown on the button before you pay and again on the secure checkout page. There is no subscription and you will not be charged again unless you choose to make another purchase.

Payments are processed by Stripe, Inc. We never see or store your full card number. Prices are in U.S. dollars and may change for future purchases; a change never affects a purchase you have already made. Applicable taxes may be added at checkout.

Your report becomes available immediately after payment at a private link. Anyone with that link can view the report, so share it only with people you choose. Save the link or your receipt to return to your report later.

4. Refunds

All sales are final, and we do not offer refunds once a report has been unlocked, except as described in our Refund Policy (for example, duplicate charges or a report that could not be delivered). Please contact us at mike@getcharlie.co before disputing a charge with your bank so we can fix the problem quickly. This policy does not limit any rights you have under applicable law.

5. Sharing and challenge links

If you create a share image or challenge link, it contains only your score, the categories you selected and, if you add it, a first name or nickname. You are responsible for what you choose to share and with whom. Do not add another person’s name or any information that is not yours to share.

6. Acceptable use

You agree not to:

• copy, scrape, resell or republish the questions, answers, reports or other content of the Service;
• interfere with or attempt to bypass payment, security or technical limits of the Service;
• forge, alter or misrepresent scores, reports or challenge links;
• use the Service for any unlawful purpose or in a way that harms others; or
• use automated means to access the Service, except standard search-engine indexing.

7. Our content

The Service, including the questions, scoring, text, graphics and software, is owned by Charlie Labs or its licensors and is protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable license to use the Service and your report for your own non-commercial purposes. GotSmarty and related names and logos are trademarks of Charlie Labs.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, CHARLIE LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS ARE ACCURATE MEASURES OF ANY ABILITY OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CHARLIE LABS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR $50. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

10. Indemnity

You agree to indemnify Charlie Labs against claims, losses and costs (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.

11. Disputes and governing law

Please contact us first at mike@getcharlie.co; most issues can be resolved quickly that way. These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in the state or federal courts located in Illinois, and you and we consent to their jurisdiction, except that either party may bring an individual claim in small-claims court.

12. Changes and termination

We may update these Terms. If we make material changes, we will update the date at the top of this page before they take effect. Changes do not apply retroactively to purchases already made. We may suspend or end access to the Service for anyone who violates these Terms.

13. Other terms

These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and Charlie Labs about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver.
